Civil Partnership Solicitors
Family Law Services
Since 2005 same-sex couples have been able to enter into civil partnerships and since 2014 same-sex couples can also marry.
Sadly, some civil partnerships do not work out and as a result, one or both of the partners may decide to start dissolution proceedings. As with a divorce there are currently two systems in place – the ‘old’ legislation and the ‘new’ no fault dissolution law.
if you filed dissolution proceedings before 6 April 2022 then your civil partnership must have irretrievably broken down and you must rely on one of four facts (unreasonable behaviour, 2 years’ desertion, 2 years’ separation or 5 years’ separation), for you to obtain a dissolution order.
Since 6 April 2022 the Applicant to the dissolution proceedings has to provide a statement of irretrievable breakdown only. Such applications can be made by one party or both parties together.
You must be in a civil partnership for 1 year before you can apply for dissolution proceedings.
The breakdown of any relationship can be difficult to contend with both practically and emotionally. O’Donnell Solicitors can provide the advice and support you need to understand your position and options as you move forward with the dissolution of your civil partnership.
Our family solicitors are also able to advise you on other options such as annulment proceedings or separation proceedings that may be suitable if a dissolution order is not an option.
If there is an international aspect to your civil partnership, then you should seek advice immediately so that you are aware of your options as to which jurisdiction you could file your proceedings in.
Whatever your situation, seeking advice from our civil partnership solicitors can help to clarify your options; helping you to decide on the best way forward. Although dissolving your civil partnership can be very emotional, our solicitors believe in providing straight-talking advice; equipping you with the knowledge you need to help make important decisions at this difficult time.
Getting a dissolution order does not result in financial claims being finalised between parties to a civil partnership.
It is important to remember that a dissolution order doesn’t just have short term consequences but can also affect inheritance, pension and other financial rights. As such, seeking specialist advice is essential.
