There are many reasons why an individual might not be able to manage their own affairs; perhaps as the result of a catastrophic injury, a degenerative condition or a disorder or disability which they have.
If you have a family member or friend who sadly lacks the mental capacity to deal with their own affairs, then we can assist you in making an application to the Court of Protection to become that person’s Court Appointed Deputy. This gives you the authority to make financial or personal welfare decisions on behalf of the individual concerned. A person’s mental health can be affected at any point during their life and If they have not provided for this eventuality by making a Lasting Power of Attorney (or a valid Enduring Power of Attorney) in advance of the loss of capacity, then an application to the Court of protection will be the correct route to follow In order to gain control of their decision making.
Our sensitive and professional team of solicitors can advise you of the court process, the relevant legislation under the Mental Capacity Act 2005, draft and make a Deputyship application on your behalf, or deal with specific applications to the Court of Protection, for example, the sale of property or preparation of statutory wills.
Taking on the responsibility of becoming a Deputy can be very stressful and time-consuming so if required, we can also assist you in managing a person’s affairs once the court order has been made.
