A Lasting Power of Attorney (LPA) is a legal document that allows you to appoint people of your choice to make decisions on your behalf should you lose your mental capacity. Taking the proactive step of creating a Lasting Power of Attorney gives you the peace of mind that there is someone you trust who has the legal authority to look after your affairs if you become unable to do so yourself during your lifetime.
There are two types of LPA; Health and Welfare and Property and Finance:
- A Health and Welfare LPA allows you to appoint one or more people to make decisions on your behalf in terms of your health and care decisions including; your personal welfare, daily routine, your medical care and life-sustaining treatment. If you have certain thoughts on how you would like to be treated, then you can make this clear within your LPA.
- A property and finance LPA on the other hand allows you to appoint one or more people to make decisions on your behalf in terms of managing your bank or building society account, buying, selling or renting properties, collecting your pension or paying bills.
You may choose to have only one or both types of LPA.
An LPA can be used as soon as it is registered and therefore if you choose, your representatives can make decisions for you before you lose mental capacity, but only with your permission.
LPA’s replaced Enduring Powers of Attorney (EPA), however, if you have already created an Enduring Power of Attorney before the change in the law in 2007, then this will still be valid and we can assist with the registration process for Enduring Powers of Attorney if required.
If you are considering creating an LPA either for your health and welfare, your property and finance or both we are happy to explain the effects of such documents to you on a face to face basis or over the telephone. Thereafter, we can draft the documents and attend to the registration formalities of the documents on your behalf. We are also able to act for couples and produce ‘mirror’ Lasting Powers of Attorneys; enabling partners to appoint each other to manage their decisions and affairs should one of them lose the capacity to do so themselves.
